In Memory of
Raymond "Nigel" "Ken" Kennedy
1928-2016

Nigel passed away peacefully with his loving family by his side. He is survived by his loving wife Mary-Anne, devoted daughter Lesley and her husband Michael, along with his two wonderful grandsons Christopher and Kennedy.
He advanced Griffin Glass into a glass and glazing industry in 1972. Nigel, his partners and all the employees in Griffin Glass built a successful commercial glass business and Calgary's skyline is marked with Griffin's ongoing contributions still today.
Nigel served on the board of the Calgary Construction Association as a director, chairing the Education and Career Development Committee. He also served as President in 1984 for the Calgary Glass and Architectural Metals Association (GAMA) and was on the executive and other committees for many years after.
He will be sadly missed by the construction community.

Memorial Services will be held at St. Andrew's Presbyterian Church. (703 Heritage Drive SW) on Thursday, September 8, 2016 at 11:00 a.m. Condolences may be forwarded through McInnis & Holloway Funeral Homes.

Contract Warranties
By Norm Streu and Christopher Hirst

Buried near the end of most construction contracts are contractual warranties. These clauses rarely receive much attention or comment but, a recent court decision has highlighted the risks inherent in these common clauses.

In Greater Vancouver Water District (GCWD) v. North American Steel and Pipe Ltd., the GVWD contracted with North American to supply steel pipe for a waterworks project. The GVWD and its consultants had prepared the design and specifications for the steel pipe that was to be supplied by North American. In the contract, North American gave two relevant warranties to the GVWD with respect to the steel pipes. First, North American warranted that the steel pipes would conform to the specifications; and second, that they would be “free from all defects arising at any time from faulty design in any part of the Goods.”

Alberta Construction Association News
On Wednesday August 31st ACA Chair Paul Verhesen, Executive Director Ken Gibson and Policy Analyst Jonathan Williams met with Energy Minister Margaret McCuaig-Boyd and her staff. During the discussions ACA offered to assist where it can to help with both Energy East and Trans-mountain pipelines.

The minister was very receptive to these offers and suggested that ACA can make a big difference on a Canadian and interprovincial level. The meeting also discussed ways we could work on common fronts to ensure we are achieving the best for Albertans.

Thank you to the minister for the time and we look forward to building a good working relationship.

On September 1, Amarjeet Sohi, Minister of Infrastructure and Communities, and Brian Mason, Alberta Minister of Infrastructure and Minister of Transportation, announced a bilateral agreement that will make more than $1.08 billion in funding available under two new federal programs – the Public Transit Infrastructure Fund and the Clean Water and Wastewater Fund.

The federal government is providing up to 50 per cent of funding – more than $543 million – for projects supported through these programs and the provincial government and municipalities will provide the balance of funding.

Also announced was an initial list of approved projects in Alberta under the Public Transit Infrastructure Fund and the Clean Water and Wastewater Fund. The list includes important investments in 46 transit projects across Edmonton to support critical planning for the city’s next LRT expansion, as well as buses, LRT cars and significant infrastructure upgrades for the city’s existing transit system. It also includes 17 water and wastewater projects, such as a regional water supply system extension in Bonnyville that will give residents access to clean and reliable drinking water, supporting future growth and quality of life, and better protecting the local environment.

BIM Canadian Developments
While BIM is still a relatively young and evolving tool in Canada, many concern regarding usage and liability have been addressed by the development of standard-form contract appendices. There has been only a handful or reported litigation involving BIM in North America from which one might conclude that the cooperative approach by all project participants is working, despite fears of shifting liabilities.
